Purchase Term & Condition :

  1. Introduction Welcome to Reeluxs Luxury, an online marketplace that specializes in luxury pre-owned goods. These Service Terms set out the terms and conditions under which you may access and use our website, located at www.reeluxs.com (the "Website"). By accessing or using the Website, you agree to be bound by these Service Terms. If you do not agree to these Service Terms, you must not access or use the Website.

  2. Service Description Reeluxs Luxury provides a platform for users to buy and sell luxury pre-owned goods, including but not limited to designer handbags, shoes, clothing, watches, and jewelry. We do not own or sell any of the items listed on our Website. We act as a facilitator between buyers and sellers, and we do not take responsibility for the authenticity or condition of the items listed on our Website.

  3. User Account In order to use certain features of the Website, you may be required to create an account and provide certain information about yourself. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your account. You agree to accept responsibility for all activities that occur under your account or password.

  4. Listing and Selling on Reeluxs Luxury As a seller, you are responsible for ensuring that all items you list on the Website are described accurately and completely, and that all images and other content you upload are of the actual item. You are also responsible for ensuring that your listings comply with all applicable laws and regulations.

  5. Buying on Reeluxs Luxury As a buyer, you agree to pay for any items you purchase on the Website and to provide accurate and complete shipping information. You are responsible for ensuring that your purchase complies with all applicable laws and regulations.

  6. Refunds and Returns All sales on Reeluxs Luxury are final. However, in the case of a dispute or if the item received is not as described, Reeluxs Luxury will work with both the buyer and seller to come to a resolution.

  7. Disclaimer of Warranties The Website and all content, materials, products and services provided on the Website are provided "as is" and "as available" without warranties of any kind, either express or implied.

  8. Limitation of Liability Reeluxs Luxury shall not be liable for any damages of any kind arising from the use of the Website or the purchase of any items listed on the Website.

  9. Dispute Resolution Any disputes arising out of or in connection with the use of the Website or the purchase of any items listed on the Website shall be resolved through binding arbitration in accordance with the rules of the Malaysia International Arbitration Centre.

  10. Changes to the Service Terms Reeluxs Luxury reserves the right to make changes to these Service Terms at any time. Your continued use of the Website following any changes to these Service Terms will be deemed acceptance of the new terms.

Consignment Agreement Terms & Conditions

Acceptance & Understanding:By using our services, you, the customer, agree to abide by Reeluxs's consignment policy and terms & conditions. It is essential that you read and fully understand all aspects of these terms before proceeding with consignment. This ensures that both parties are aware of their rights.

Parties Involved

    • Consignor (Customer): The owner of the luxury item.

    • Consignee (Shop): The business responsible for selling the item on behalf of the consignor.

Proof of Authenticity and Item Inspection

    • Proof of Authenticity: Consignors must provide receipts, authenticity cards, and other relevant documents.

    • Item Inspection: The consignee 🇲🇾will examine the actual condition of the item, including certificates, authenticity cards, receipts, dustbags, and boxes.

Quotation Process and Pricing Agreement

    • Quotation Process: The item's condition will be evaluated by the quotation team.

    • Seller's Price Expectation: The seller may suggest an agreed price, which will be assessed for market compatibility.

    • Price Agreement: Prices will be pre-discussed and agreed upon between the consignee and consignor ..

Pricing Stability and Communication

    • Fixed Pricing: Once a price is agreed upon, it will remain unchanged during the consignment period, except under extraordinary circumstances such as significant market shifts.

    • No Frequent Changes: To maintain operational efficiency and customer trust, frequent price changes are prohibited.

    •  Consignment Price Notification Policy:

  •  Items will be sold within the agreed price range without further notification to the owner.

  • If a potential buyer offers a price lower than the specified range, the consignee will call to consult the owner to obtain the latest agreed transaction price.

Term of Consignment and Retrieval Policies

    • Minimum Consignment Period: Items must remain in the consignee's possession for a minimum of one month, with an automatic monthly renewal unless terminated by the consignor.

    • End Consignment Notification: A 10-day advance notice is required to terminate the consignment and retrieve items.

    • Advance Notice for Collection: If items are to be retrieved before the end of the consignment period, a 10-day notice is also required. During these final 10 days, items may still be promoted to maximise sales opportunities.

    • Penalty for Early Retrieval: 30 % penalty of the item's last consigned value will be charged if retrieved without adequate notice or before the contract ends.

Consignment Fee

    • Fee Structure: The consignee will charge a consignment fee of 10% of the agreed price of the item when sold on behalf of the consignor.

Payment Terms

    • Method of Payment: Payments for items sold will be made  via bank transfer. Payment will be completed within 1-7 working days after the sale of the item.

    • Stolen Goods Policy

      • Prohibition of Stolen Goods: The sale of stolen goods is strictly prohibited. Consignors must ensure all items are legally owned or authorised for sale.

      • Procedure Upon Discovery: Immediate notification to authorities and cooperation with any investigations

      • Consignor Liability: Consignors assume all risks and liabilities for consigning stolen goods and will face legal consequences if items are found to be stolen.

      • Verification Requirement: Proof of ownership or authorization is required from consignors 

      • Dispute Resolution

       

    • Mechanisms: Specific mechanisms will be in place to resolve any disputes arising from the consignment agreement.

    • Conditions inspection, pricing determination, authenticity requirements, penalties for counterfeit items, handling of stolen goods, payment methods, and the right to amend terms without prior notification.

Additional Provisions

    • Conditions Inspection & Pricing Determination: Based on demand, condition, and age.

    • Authenticity Checks and Penalties for Counterfeits: 

- Any item discovered to be counterfeit will incur a retrieval penalty of RM300 per item, or RM500 per Hermes & Watch item.

- Counterfeit items not collected within 7 days of notification will be disposed of, and the consignee  reserves the right to litigate.

  • Amendment of Terms: Consignee reserves the right to modify these terms without prior notification.

  • Acceptance of Terms: By completing the buyout form, the consignor is considered to have accepted these terms.

Operational Consistency and Non-Interference Policy

Backend Operations Non-interference

  • Customer Limitations: Customers are not permitted to interfere with backend operations or influence the regulations established by consignee’s partners. This policy ensures that our operational integrity and the efficiency of our services are maintained without disruption.

Operational Consistency

  • Standard Protocols: Consignee adheres to specific methods and protocols for consignment sales, which are grounded in industry best practices. This commitment ensures the delivery of consistently high-quality and equitable deals for all parties involved.

Non-Interference

  • Process Integrity: Customers are prohibited from interfering with established backend operations, including dictating service execution or disrupting workflow during ongoing operations. Specifically, customers cannot specify how items should be displayed or promoted. All items submitted for consignment must be managed according to our  standardised procedures, ensuring consistency and maintaining a professional standard.

Communication Channels

  • Initial Consultations: Our values customer input and encourages open discussions prior to the commencement of consignment. This approach ensures that both parties fully understand and agree upon all terms and procedures involved in the consignment process. After these initial consultations, all operational decisions during the consignment period are managed exclusively by our marketing arrangement team to ensure professionalism and adherence to the agreed standards.

Collaboration with International Marketing Platforms

Partnership Scope

  • Engagement Strategy: We collaborate with numerous marketing platforms across local and international markets. These partnerships are managed by a specialised third-party team focused on developing and executing effective marketing strategies.

Operational Autonomy

  • Independent Operations: The third-party team operates autonomously, managing its own operational expenses to provide tailored marketing solutions.

Fee Structure

  • Financial Autonomy: Each platform independently manages its financial obligations, including maintenance, service charges, team handling costs, advertising expenses, currency transactions, and shipping fees.

Pricing Autonomy

  • Independent Pricing: Pricing strategies are determined independently by the respective marketing teams of these platforms, based on the specific operational costs incurred.

Relationship with Third-Party Platforms

  • Operational Independence: Authorised by consignee for marketing and advertising, these platforms operate independently without direct oversight from Buy Luxury.

  • Pricing Integrity: Pricing agreements between consignee and its customers are independent and do not correlate directly with the operations of these third-party platforms.

Customer Privacy Protection Policy

1. Responsibility as Intermediary

Firmly committed to protecting the confidentiality and security of personal information for both owners and buyers. We ensure that all transactions are conducted with the utmost respect for privacy, maintaining a high standard of integrity and trust in every interaction.

2. Restriction on Information Sharing

It is strictly prohibited for owners to request or receive any personal information about buyers, and likewise, buyers are prohibited from requesting or receiving any personal information about owners. This includes, but is not limited to, contact details, payment information, and any other sensitive data. This measure is critical to maintaining the privacy and confidentiality essential to the integrity of our services.

3. Enforcement

Violations of this policy result in immediate inclusion on a permanent service blacklist, reinforcing compliance and safeguarding the community against breaches of trust and privacy.


Policy for Old Shoes Consignment:

•If consigned shoes remain unsold after 6 months, we will request that the customer retrieve their items.

•This policy is in place because, over time, the soles of older shoes may naturally oxidize, even if there are no visible issues at the time of consignment.

•Oxidation is not detectable through a standard inspection. If a buyer purchases the shoes and they crack or become damaged within 7 days of wear, the buyer has the right to return them. In such cases, the owner will be responsible for the item.

Acceptance & Understanding:By using our services, you, the customer, agree to abide by Reeluxs‘s consignment policy and terms & conditions. It is essential that you read and fully understand all aspects of these terms before proceeding with consignment. This ensures that both parties are aware of their rights.

  • Minimum Consignment Period: 1 Month : (During the first month of the consignment period, items cannot be retrieved and must remain in our possession for a minimum of one month)
  • End of Consignment Notification: 30+10 days : ( 10 days in advance after the due date is required for notification)
  •  Early Withdrawal Penalty :( Penalty fee of 30% of the agreed price will be charge. )
  • Consignment Fee: 10% : ( A 10% consignment fee will be charged based on the agreed price.)
  • Important Notes :( No additional notification when items are sold within the agreed price range, offers below the agreed price range will be discussed and re-confirmed.) 
  • Marketing and Management Rights: ( The consignor has no authority to control or influence any marketing strategies or activities once the consignment agreement is signed and effective.)
  • Payment Process: ( Payment transactions will be completed within 1–7 working days.)

 

Terms and Conditions of Item Buyout

  • Item Inspection :Our team will examine the physical condition of the item, along with all accompanying materials such as certificates, authenticity cards, receipts, dust bags, and boxes.
  • Quotation Process :The item details will be submitted to our Quotation Team for evaluation and price estimation.
  • Seller’s Price Expectation : The seller may indicate their preferred selling price, which will be reviewed against our internal evaluation value.
  • Price Agreement :A mutually agreed price will be finalized between the Seller and Buyer before proceeding.
  • Authentication Process :Upon price agreement, the item will undergo a professional authenticity check, typically taking between 15 to 30 minutes depending on the number of items.
  • Photography Session :The item will then be brought to our second-floor HD studio for detailed photography and record purposes.
  • Payment After Authentication:Payment will be processed only after the authenticity check has been successfully completed and verified.

 

Item Buyout Agreement

  1. Condition Inspection & Pricing Determination
     All prices and valuations are determined by Reeluxs based on factors such as market demand, brand, condition, age, and resale potential. Any discounted or adjusted prices will be discussed and agreed upon prior to confirmation.

  2. Authenticity Requirement
     Buy Luxury only accepts 100% authentic pre-owned or unused luxury items. Any item found to be counterfeit or unauthentic will be subject to penalties as outlined below.

  3. Penalty for Counterfeit Items
     Any item identified as counterfeit will incur a retrieval penalty of RM300 per item, or RM500 per Hermès item. Counterfeit items not collected within seven (7) days of notification will be disposed of, and Buy Luxury reserves the right to take legal action.

  4. Stolen Goods Policy
     The sale or consignment of stolen goods is strictly prohibited. All sellers or consignors must ensure that the items are legally owned and authorized for sale. If any item is suspected or confirmed stolen, Reeluxs will immediately notify the authorities and fully cooperate with investigations. The consignor bears full liability and legal responsibility for any stolen items found under their name, and proof of ownership or authorization may be requested before the transaction proceeds.

  5. Authentication & Payment
     Buyout payments will be processed only after successful verification of authenticity. Certain items may require additional time depending on the authentication process. All payments will be made exclusively via online bank transfer to ensure traceability and compliance.

  6. Finality of Transaction (  non-reversible )
     Once the transaction has been confirmed and signed by the customer, it is deemed final, and ownership is officially transferred. All confirmed transactions are strictly non-reversible. No return, refund, or buy-back requests will be accepted under any circumstances.

  7. Amendment of Terms
    Reeluxs reserves the right to amend, update, or supplement these terms and conditions at any time without prior notice.

  8. Acceptance of Terms
    By completing and signing this Buyout Agreement, the seller confirms that they have read, understood, and fully accepted all the terms and conditions stated above. The transaction conducted on the date of signing is deemed to have been made under the seller’s full consent and acknowledgment.
